Terms of Use

These Terms of Use ("Terms") apply when you visit or use grixfit.com and its pages, guides, videos, images and blog (the "Site"). The Site is run by Grixhub, based in Bangkok, Thailand ("Grixhub", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site offers free exercise guides, articles, and video clips and images that show exercise form. You can use it without an account, and we do not sell anything on the Site.

The GrixFit app is a separate product that we are developing. The Site may describe it or let you join a waitlist, but the app will have its own terms and privacy notice, and these Terms do not cover it.

2. Health and safety: not medical advice

Please read this section carefully.

General information only. Everything on the Site is general fitness information for healthy adults. It is not medical, physiotherapy, nutrition or other professional advice. It is not tailored to you, and it does not replace a consultation, diagnosis or treatment from a doctor or qualified professional. Using the Site does not create a doctor–patient, trainer–client or other professional relationship.

Talk to a doctor first. Check with a doctor or qualified health professional before you start any exercise programme or change your activity, especially if you are pregnant or have recently given birth, are over 40 or have not exercised for a long time, or have or may have heart, lung, blood pressure, joint, bone, back, metabolic or other health conditions, an injury, or take medication.

Stop if something feels wrong. Stop exercising straight away and get medical help if you feel pain, chest pain or tightness, dizziness, faintness, severe shortness of breath, nausea or any other unusual symptom. In an emergency in Thailand, call 1669.

Know your limits. Use the Site only within your own fitness level and ability. Warm up, use safe equipment and a safe space, and get supervision from a qualified person when you need it. Our videos and images show form for demonstration. Your body, equipment and surroundings may differ.

Assumption of risk. Exercise carries a natural risk of injury, illness and, rarely, more serious harm. You decide whether, how and how hard to exercise. To the extent the law allows, you take on these ordinary risks of exercise when you choose to follow any content on the Site.

Limits of this section. Nothing in these Terms excludes or limits our liability for death or bodily injury caused by our act or negligence, for our wilful misconduct or gross negligence, or for any other liability that Thai law does not allow us to exclude or limit, including under the Unfair Contract Terms Act B.E. 2540 (1997).

Age limit. The Site and the waitlist are for people aged 20 or over only. If you are under 20, please do not use the Site or join the waitlist.

3. Accuracy of content

We work to keep our content accurate and up to date, but fitness knowledge changes and mistakes can happen. We do not promise any particular result, such as weight loss, strength or performance. Results depend on many things outside our control. We may change or remove content at any time.

4. Our content and intellectual property

All content on the Site, including text, exercise guides, videos, clips, images, illustrations, graphics, the GrixFit name and logo, and the Site's design, belongs to Grixhub or to people who have licensed it to us. It is protected by Thai copyright and trademark law and by international treaties.

What you may do: view the Site and print or save a page for your own personal, non-commercial use, and share links to our pages.

What you may not do without our written permission:

• copy, download (other than for personal offline viewing where your browser allows it), re-upload, republish, sell, license or broadcast our videos, images or guides;
• use our content in your own product, app, course, social media channel or coaching service;
• remove watermarks, credits or copyright notices;
• use our content to train or build AI or machine-learning models, or scrape it in bulk; or
• use the GrixFit or Grixhub names or logos in a way that suggests we endorse you.

To ask for permission, email us (see Section 11).

5. Acceptable use

When you use the Site, you agree not to:

• break any law, or infringe anyone's rights;
• try to hack, overload, disrupt or get unauthorised access to the Site, its servers or its data;
• use bots, scrapers or other automated tools to collect content or data, except normal search-engine indexing;
• send spam, malware or harmful code, or submit false or someone else's details in a form; or
• use the Site to harass, mislead or harm others.

We may block access to the Site, or delete form submissions, if we reasonably believe these Terms have been broken. Under the Computer-related Crime Act, we keep certain logs and may share them with authorities when the law requires it.

6. Waitlist and contact forms

You must be aged 20 or over to join the waitlist. If you join a waitlist or contact us, you must give true details and an email address you are allowed to use. Our Privacy Policy explains how we use them. Joining a waitlist is free, does not commit you to buy anything, and does not guarantee a launch date, a price or access.

7. Prices, payments and refunds

Nothing is sold on the Site, so no payments or refunds are made here.

If we later offer paid features in the GrixFit app, such as a Pro subscription, the price, currency, billing period and payment method will be shown before you buy, under the app's own terms. Fees paid are non-refundable, except where Thai law requires a refund. Grixhub is not registered for VAT, so no VAT is charged.

8. Links and other services

The Site may link to, or show content from, other websites, apps or services. We do not control them and are not responsible for their content, products or privacy practices. Your use of them is under their own terms.

9. Availability and changes

The Site is provided free and "as available". We may change, pause or close the Site, or any part of it, at any time. We do not promise that it will always be available, uninterrupted or free of errors or harmful components, although we take reasonable steps to keep it safe.

10. Limitation of liability

To the extent Thai law allows:

• we are not liable for loss or damage arising from your use of, or reliance on, the Site's general information, or from risks of exercise you have chosen to take on as described in Section 2;
• we are not liable for indirect or consequential loss, such as loss of income, data or opportunity; and
• because the Site is free and you pay nothing to use it, to the fullest extent Thai law allows we have no liability to you for any other claim relating to the Site (a liability limit of ฿0).

Nothing in these Terms limits or excludes liability for death or bodily injury caused by our act or negligence, for wilful misconduct or gross negligence, or any liability that cannot be limited or excluded under Thai law, including the Unfair Contract Terms Act B.E. 2540 (1997) and consumer protection law. These limits apply only as far as they are fair and reasonable under that Act.

12. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date. If a change is significant, we will show a notice on the Site. If you keep using the Site after a change, the new Terms apply.

13. Governing law and disputes

These Terms are governed by the laws of Thailand. Please contact us first, so we can try to resolve any issue informally. Any dispute that we cannot resolve will be decided by the competent courts in Bangkok, Thailand. This does not take away any right you have, as a consumer, to use mandatory protections or bring a claim in a court that the law of your country of residence gives you.

14. General

If any part of these Terms is found invalid or unenforceable, the rest stays in force, and the invalid part applies to the fullest extent the law allows. If we do not enforce a right straight away, we have not given it up. These Terms, with our Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Site. If these Terms are translated, the English version applies.
